Many russian people moved to America in 1800's, 1900's, and 1950's and they will keep doing it. It is legal, and the kid is not a spy :)

Don't know about kids, but more than 50% of people, who speak Russian in US are so called "russian jews". Means, they got their immigration visas to US because somebody from their families was / is been a Jew, however they have no clue, what Jews are about. Sure, they're more happy to speak Russian than Hebrew ;) And yes, independent on how legal a kid is- it's allowed to visit public school and no one at the school may ask kid for it's status in US.

why wouldn't you just ask the kid? And - yes, of coarse, there are numerous different ways to move from Russia to USA legally.
